the subtitles don't match the audio timing meaning the subtitles will appear when the saying is finished not during

In episode 3 using vlc media player it is 1.5 seconds off

There are no other reports of problems with ep3 here or on Nyaa, so you are on your own. You probably know can manually change the timing during playback. I would try another player, like K-Lite (search Wikipedia for download info). VLC is a problem player these days.
